CMS exempts end stage renal disease facilities from NFPA 101

The Centers for Medicare and Medicaid Services (CMS) has exempted many end-stage renal disease (ESRD) facilities from requirements under NFPA 101: Life Safety CodeŽ. Under a new CMS memo, the only ESRD facilities that must still comply with NFPA 101 are those adjacent to high hazardous occupancies and those that do not exit to the outside at grade level from the patient treatment area. All ESRD facilities are still required to comply with state and local fire codes and other safety standards. CMS published regulations in 2008 requiring ESRD facilities to comply with provisions of NFPA 101. CMS said in its new memo that the agency has since determined that many of the structural requirements included in the Life Safety Code are unnecessary in ESRD facilities. CMS said the NFPA 101 requirements support a defend-in-place fire strategy, but in ESRD facilities the fire evacuation process entails a patient's rapid disconnection from a dialysis machine and quick exit. The full CMS memo is available online.
